Copyright and DMCA Policy

ARCQTYPE, LLC. ("ARCQTYPE", "we") respects the intellectual property of others and expects users of ARCQTYPE apps and arcqtype.com to do the same. We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512.

How to send a notice

Your notice must be in writing and include:

  1. Your physical or electronic signature, as the copyright owner or a person authorized to act for the owner.
  2. Identification of the copyrighted work you claim is infringed.
  3. Identification of the material you claim is infringing, with enough detail for us to find it (for example, a link or a profile and post).
  4. Your name, address, phone number and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner.

When we receive a complete notice, we remove or disable access to the material and tell the user who posted it.

Counter-notice

If your material was removed and you believe this was a mistake or a misidentification, you may send our designated agent a counter-notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which ARCQTYPE may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.

We send the counter-notice to the person who sent the original notice. We may restore the material in 10 to 14 business days after we receive the counter-notice, unless that person tells us that they have filed a court action to stop the infringement.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe the copyrights of others.

False claims

A person who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages under 17 U.S.C. § 512(f).
